LOCAL LAW NO. 3 OF 1993
A LOCAL LAW REGULATING THE ACCUMULATION AND STORAGE OF AUTOMOBILE OR OTHER MOTOR VEHICLE USED TIRES WITHIN THE TOWN OF CANDOR
Be it enacted by the Board of Councilmen and councilwomen of
the Town of Candor, County of Tioga and State of New York, as
follows:
SECTION 1. FINDING.
A clean, wholesome, attractive
environment is hereby declared to be of importance to the health,
safety and general welfare of the inhabitants of the Town of
Candor and to the orderly development and improvement of the
Town. The Board of Councilmen and councilwomen of the Town of
Candor have determined that the unrestrained accumulation within
the Town of Candor of used tires from motor vehicles constitutes
a hazard to such environment, to such development and to such
general welfare of the inhabitants. Accordingly, such
accumulation is prohibited as follows:
SECTION 2. PROHIBITION.
No person, persons, partnership,
corporation or other entity shall collect, store, allow to be
collected or allow to be stored any used motor vehicle tires on
property located within the Town of Candor outside of a building.
SECTION 3. EXCEPTIONS.
This Local Law shall not apply to
any junkyard licensed to operate within the Town of Candor, to
any motor vehicle repair shop licensed by the State of New York
to operate within the Town of Candor, any new tire dealer, heavy
equipment operator, agricultural operations requiring used tires
as a method for holding down covers for storage of agricultural
products and any business engaged in the recycling of such used
tires.
SECTION 4. PENALTIES.
Any person who shall violate this
Local Law shall be guilty of an offense and upon conviction shall
be punished by a fine not exceeding $250.00 or by imprisonment
not exceeding fifteen (15) days or both.
SECTION 5. ENFORCEMENT.
This Local Law shall be enforced
by the Code Enforcement Officer of the Town of Candor. In the
enforcement of this Local Law, such Code Enforcement Officer or
any Peace Officer shall be authorized, pursuant to Section 150.20
of the Criminal Procedure Law to serve a summons, to serve and
issue any orders or process in the administration of the
procedures of this Local Law and in addition, may issue an
Appearance Ticket, a Uniform Appearance Ticket and/or simplified
information related to any proceeding commenced under this Local
Law whether such be criminal or civil in nature.
SECTION 6. EFFECTIVE DATE.
This Local Law shall take effect 1/1/1994.
