SECTION 1. SHORT TITLE
1.1 This Local Law shall hereafter be known and cited as the of
Solar and Wind Energy Tax Exemption Removal Local Law of the Town
of Candor.
SECTION 2.0. AUTHORIZATION
2.1 section 487 of the Real Property Tax Law of the State of
New York provides for an exemption to be available for the
increase in assessment due a taxpayer for the installation of
solar and wind energy equipment within the State of New York.
Subdivision 8 of Section 487 permits municipalities including
Towns to provide by Local Law that no such exemption allowed
under the Section be applicable within its jurisdiction with
respect to any such solar or wind energy systems constructed
subsequent to January 1st, 1991 or the effective date of such
Local Law whichever is later.
SECTION 3.0. GENERAL PROVISION
3.1 No exemption shall be available within the Town of Candor
for the increase in assessment which may result from the
installation or construction of any solar or wind energy system
or systems by any taxpayer to or on their property within the
Town of Candor.
SECTION 4.0. EFFECTIVE DATE
4.1 This Local Law shall be effective upon filing with the
Secretary of State in accordance with Section 27 of the Municipal
Home Rule Law.
